1. Acceptance of Terms

By downloading, installing, or using PGMS ("App", "Service"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our application.

These Terms apply to all users of the App, including property owners, managers, tenants, and any other users who access or use the Service.

2. Description of Service

PGMS is a comprehensive mobile application designed to facilitate the management of Paying Guest (PG) accommodations, hostels, and rental properties. Our services include:

  • Property Management: Tools for property owners to manage multiple properties, rooms, beds, and facilities
  • Tenant Management: Registration, verification, and management of tenant information
  • Payment Processing: Digital rent collection, payment tracking, and receipt generation
  • Food Management: Meal preferences, menu management, and food service coordination
  • Communication: SMS notifications and announcements to tenants
  • Complaint Management: Issue reporting and resolution tracking
  • Reports & Analytics: Business insights and occupancy reports

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

3.3 Account Types

  • Owner Account: For property owners with subscription-based access
  • Manager Account: For property managers assigned by owners
  • Tenant Account: For tenants residing in managed properties
  • Chef Account: For food service staff managing meal preparations

4. User Responsibilities

As a user of PGMS, you agree to:

  • Provide accurate and truthful information, including valid identity documents (Aadhaar, PAN)
  • Use the App only for lawful purposes and in compliance with applicable laws
  • Not share your account credentials with unauthorized persons
  • Not attempt to gain unauthorized access to other users' accounts or data
  • Not use the App to harass, abuse, or harm others
  • Not upload false, misleading, or malicious content
  • Comply with all applicable local, state, and national laws regarding property rental

5. Subscription and Payments

5.1 Subscription Plans

Property owners must subscribe to a paid plan to access management features. Subscription plans vary based on the number of properties, tenants, and features included.

5.2 Payment Terms

  • All payments are processed securely through our integrated payment gateway
  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to modify pricing with reasonable notice

5.3 Tenant Rent Payments

Tenants may pay rent through the App. The App facilitates payment processing but is not responsible for disputes between tenants and property owners regarding rent amounts or timing.

6. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

We collect and process personal information including:

  • Identity verification documents (Aadhaar, PAN)
  • Contact information (phone number, email, address)
  • Property and accommodation details
  • Payment and transaction history
  • Food preferences and consumption data

7. Intellectual Property

The App, including its content, features, and functionality, is owned by PGMS and is protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer or attempt to extract the source code
  • Use our trademarks, logos, or branding without permission
  • Create derivative works based on the App

8. SMS and Notifications

By using our Service, you consent to receive SMS notifications for:

  • Payment reminders and confirmations
  • Account-related alerts and updates
  • Important announcements from property management
  • Security notifications (OTP, login alerts)

Standard messaging rates may apply based on your mobile carrier.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided "as is" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • We are not liable for any disputes between property owners and tenants
  • Our total liability shall not exceed the subscription fees paid by you in the past 12 months
  • We are not responsible for any damages arising from third-party services integrated with the App

10. Termination

We reserve the right to suspend or terminate your account and access to the App at our discretion, without prior notice, for conduct that we believe:

  • Violates these Terms and Conditions
  • Is harmful to other users or third parties
  • Is fraudulent or illegal

Upon termination, your right to use the App will immediately cease. Data retention will be governed by our Privacy Policy and applicable laws.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be:

  • First attempted to be resolved through mutual negotiation
  • Subject to the exclusive jurisdiction of courts in India
  • Governed by the laws of India

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Indemnification

You agree to indemnify and hold harmless PGMS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
